What Happens After You File a Claim
Once your claim is filed, your employer’s insurer is responsible for paying for all treatment necessary to cure or relieve the effects of your work-related injury. This includes ER visits, imaging, surgeries, specialist consultations, and physical therapy—until your condition stabilizes or reaches maximum medical improvement (MMI).
Billing and Fee Schedules
New York sets medical reimbursement rates in its Medical Fee Schedules. These rates are binding and ensure predictable payment. Starting August 1, 2025, the WCB requires all providers to use the CMS-1500 form for billing electronically to improve efficiency.
What if the Insurer Delays or Denies Treatment?
Insurance carriers must respond promptly to treatment requests. If they delay or deny medically necessary care, you can file a Request for Assistance or pursue a hearing through the Board. An IME (Independent Medical Examination) may also be requested to resolve disputes over treatment.
