Cinderblocks Fall Off Wall onto Head of a Queens County Worker

A Scenic Artist was on his first day inside a Queens County warehouse helping paint set walls for a television show. Within 45 minutes of starting his work, two cinderblocks fell off the top of a 10-foot interior wall and struck him directly on the head and shoulder. The school never informed her parents that they were having a 14-year-old male student supervise their daughter during the speech class. The infant plaintiff was repeatedly molested during 4 separate speech classes by the 14-year-old on her private areas while they sat next to one another in the small classroom with only the teacher and one other young male student present. The male student on the fourth day forced the girl’s hand inside his pants and she pulled free, walked out, and told her parents everything. The police were called and the male student was arrested. Nassau County Woman Falls from Mis-Leveled Elevator

A pedestrian was struck and killed in Brooklyn by a driver of a dump truck while crossing the street inside the crosswalk. After the driver initially stopped he then decided to go through the red light and stuck the plaintiff while making a left turn. 01. If you were injured in a workplace accident, can you have a personal injury case in addition to a Workers Compensation claim?

Yes, although generally you are not permitted to sue your employer for a work accident, you are entitled to sue another party that caused the accident while working. In those circumstances a person can have both a Workers Compensation claim and a personal injury case.

02. What steps should someone take immediately following a workplace accident?
A person should promptly notify their employer in writing, which can include an email. Take photos and videos of the place and cause of the accident, obtain names and phone numbers of all witnesses, and call an experienced work accident attorney to help you.
03. After a car accident, how long does a person have to file a lawsuit in New York?
If the other driver worked for a municipality such as New York City, a Town, or a Village, a Notice of Claim must be served within 90 days of the accident and a lawsuit commenced within one year and 90 days. For all other defendants, the time to commence a lawsuit is generally three years from the date of accident. There are always exceptions, so it is best to consult an experienced personal injury lawyer immediately.
04. Can construction workers recover compensation even if no one was directly negligent?

Yes. Under New York Labor Law §240, building owners have a duty to make sure workers are provided with proper protection and safe equipment to perform their tasks. The failure of a ladder to properly support a worker may be enough to hold the building owner legally responsible, even without proving traditional negligence.

05. What is the typical timeline for a personal injury lawsuit in New York?

A case can be resolved in three months or take over three years, depending on many factors. One factor is the courthouse. Cases in the Bronx have fair juries, but due to the volume of cases in that courthouse, trial can take several years.

Compensation can include an award for pain and suffering, loss of enjoyment of daily life activities, lost earnings, and medical expenses. A spouse of an injured accident victim may also recover for the losses associated with caring for their injured partner. A fair settlement amount is determined by the client with the careful advice of the attorney after discussing all variables and risks.

07. What does a personal injury attorney do, and what costs should a client expect?

A personal injury lawyer provides all necessary litigation skills to help an injured victim get fair compensation with almost no risk to the client. As a general rule, if there is no recovery, there is no attorney fee. If there is a recovery, the attorney fee is usually one-third of the award, including litigation costs such as courthouse fees, court reporter fees, and similar expenses.
