When to File a Car Accident Claim Against Another Driver

New York’s no-fault accident insurance system allows injured drivers to file claims with their own auto insurance companies for payment of medical bills related to the auto accident, as well as limited amounts for lost earnings.  However, compensation for pain and suffering would be against the responsible party causing the accident and requires proving both fault and a serious injury.  Governor Hochul also recently changed the law in 2026 to make it even more difficult for accident victims to obtain a recovery.  If a person is over 50% at fault for the accident they are no longer allowed to receive any compensation.  This law will be used by insurance companies to try and negotiate lower settlements simply because of the risk an accident victim takes of going to a jury and possibly getting nothing if the jury finds they were more than 50% at fault for the accident.

The Empire State defines “serious injury” under New York Insurance Law 5102(d) to include injuries resulting in death; dismemberment; significant disfigurement; a fracture; loss of a fetus;
permanent loss of use of a body organ, member, function or system; permanent consequential limitation of use of a body organ or member; or significant limitation of use of a body function or system. There was a rule that allowed a serious injury if a person was unable to do their usual activities for the first 90 out of 180 days after the accident, but Governor Hochul removed that law as well to the detriment of accident victims.  

Drivers may also seek recovery for economic damages that exceed the statutory $50,000 for all auto policies.  Even if a driver purchased their insurance policy in another state, everyone driving in New York will be provided with the statutory $50,000 basic economic loss coverage regardless of fault.   

Comparative Negligence in New York Car Accidents

For decades, New York was a pure comparative negligence state — an injured person could recover damages and fault would be apportioned.  A person found 80 percent at fault for an auto accident by a jury would be limited to recovering 20 percent of the total damages a jury awards.   That law changed for car accident cases in 2026 based upon Governor Hochul’s push for tort reform claiming this would lower everyone’s insurance premiums.  There was nothing in the law that required insurance companies to lower their premiums. As part of the state budget signed on May 27, 2026, New York added a new subsection (b) to CPLR § 1411 that shifts motor vehicle injury cases to a modified comparative negligence system. Under the new rule, if you are found 51% or more at fault for a car accident, you are barred from recovering damages entirely. If your share of fault is 50% or less, you can still recover, but your compensation is reduced by your percentage of fault.

A few caveats: this modified rule applies only to motor vehicle injury cases filed on or after the law’s passage. Pure comparative negligence still governs most other personal injury claims in New York. Because the law is only weeks old, it will take years to see how the courts address this new laws for motions made for summary judgment. For certain, insurance companies will try to negotiate lower settlements because of this new law and the added risks of injured accident victims being precluded from any recovery. What Not to Say to Car Insurance Companies After an Accident

You should not discuss anything with the defendant’s insurance company after an accident, or any investigator they send.  You will have to speak with your own insurance company that is providing the no-fault benefits about the accident and they can even request a sworn deposition, called an EUO (examination under oath) as per the terms of the insurance policy.  It is always better to have an accident lawyer in New York guiding you about these procedures right after an accident.

The timeframe you have to file a claim after an accident is governed by the statute of limitations. In New York, the statute of limitations for car accident claims is generally three years from the accident date. However, there are many exceptions, including if the defendant driver was a municipal worker, in which case, a Notice of Claim would have to be served within 90 days of the accident, and a suit filed withing 1 year and 90 days of the accident.  There are so many exceptions that you should immediately contact a NYC car accident attorney as soon as possible after the crash.

No-Fault insurance covers necessary medical expenses up to your policy’s limit. The minimum no-fault policy coverage is $50,000, but additional coverage can be available.  If you were seriously injured, you may start a lawsuit against the driver at fault and owner of their vehiclet

Can I Receive Compensation if I Was Partially at Fault?

You may be able to receive compensation if you were partially at fault, as long as your fault does not exceed 50%. New York just began in 2026 a modified comparative fault system for car accident cases only. Governor Hochul introduced this law as a tort reform measure which took away New Yorker’s rights.  Now if your fault is 51% or more, you cannot recover compensation for pain and suffering from the at fault party. If your fault is 50% or less, you may recover, but your compensation will be reduced by your percentage of fault.
