The patient’s blood pressure remained high during the surgery and he had a 30 minute hypertensive emergency at the end of the surgical case. The stroke was diagnosed within hours of the surgery.
Medical malpractice verdict for 55 year old man who suffered massive internal bleeding and brain injury because the surgeon negligently cut the common iliac artery during a lumbar surgery. The anesthesiologist was also negligent for failing to communicate signs of internal bleeding to the surgeon during the operation.
In Queens County, a Polish speaking woman was walking her dog together with a friend who was also walking a dog. Suddenly, they saw a large husky unleashed and without its owner approach. The dog started to attack the dogs and eventually attacked and bit the two women. BBNR represented one of the women and the case settled before trial.

A Polish speaking woman was walking on the sidewalk when she tripped on an oil truck delivery hose. The hose was not bright colored and no sign was near to warn pedestrians. The case settled before trial.

We obtained testimony from Church workers that the stairs get slippery and were a little bit dangerous. We also called their own experienced engineer to show the stairs were different heights and did not comply with building codes.

The landlord admitted at the deposition that ice was a recurring condition in that area due to the drainpipe. He also conceded that he saw ice on the walkway the morning of the accident but failed to properly remove it. We made a motion for summary judgment to find the defendant at fault as a matter of law and won, resulting in the immediate settlement.

The driver of the other vehicle had a stop sign and claimed she was inching forward but had her vision blocked by shrubbery. Plaintiff’s counsel won summary judgment finding 100 percent liability against the defendant. The plaintiff then won a large jury award in a damages trial, and then won the defendant’s appeal. The defendant was required to pay 9% interest on top of the verdict award.
Spanish speaking Construction worker who fell off a 6 foot ladder and onto construction debris covering the floor, resulting in serious injuries. The plaintiff required a lumbar spinal surgery, multiple knee surgeries, and a wrist repair surgery after the plaintiff cut his wrist due to severe depression. When the lower court denied plaintiff’s motion for summary judgment, we appealed and won, resulting in 100 percent liability against the defendant. The defendants settled the case shortly afterwards.
Award after Winning Jury Trial
A Scenic Artist was on his first day inside a Queens County warehouse helping paint set walls for a television show. Within 45 minutes of starting his work, two cinderblocks fell off the top of a 10-foot interior wall and struck him directly on the head and shoulder. He suffered brain trauma, cognitive difficulties, memory loss, panic attacks, anxiety, and depression. He also required a cervical fusion and was never able to resume working.
Award just before Trial
A woman working in a Nassau County office building when she was seriously injured after tripping on a mis-leveled elevator. The defendant building owner had security cameras facing the elevator but tried to conceal that they had the footage. After repeated motions by Mr. Nomberg with the defendant offering no explanations for not producing the video surveillance, the judge sanctioned the defendants by issuing an order finding them responsible for the accident as a matter of law and setting a date for trial.
Settlement after Selecting a Jury
A 7-year-old girl attending a public school was told she needed speech therapy. The school never informed her parents that they were having a 14-year-old male student supervise their daughter during the speech class. The infant plaintiff was repeatedly molested during 4 separate speech classes by the 14-year-old on her private areas while they sat next to one another in the small classroom with only the teacher and one other young male student present. The male student on the fourth day forced the girl’s hand inside his pants and she pulled free, walked out, and told her parents everything. The police were called and the male student was arrested. A Family Court judge allowed the male student to return to school and dismissed the case without a trial.
Award after Picking Jury
A construction worker in Westchester County was struck in the head by a 5-gallon paint bucket being hoisted to the roof above him. Under New York Labor Law §240, the owner of the building was responsible for ensuring workers were protected from falling objects. Brett Nomberg won summary judgment establishing 100 percent liability against the defendants. With liability decided the only issue for trial was how much to award in damages. The defendants and their insurance company then wanted to settle and agreed to pay $875,000 right we picked a jury.
Settlement for entire Insurance Policy Limit
A pedestrian was struck and killed in Brooklyn by a driver of a dump truck while crossing the street inside the crosswalk. After the driver initially stopped he then decided to go through the red light and stuck the plaintiff while making a left turn. Mr. Nomberg and the family worked to obtain video footage of the accident and immediately put the case into suit. Within weeks, Mr. Nomberg made a motion for summary judgment asking the court to find the defendant, employer, and owner of the vehicle responsible for the accident as a matter of law.
Settlement Shortly before Trial
A student was pushed off the bleachers by another student inside the school gymnasium during an after-school program breaking her arm that required surgery. The students were not permitted to be on the bleachers but two of the teachers left the gym and the third was busy playing basketball instead of supervising the 10 students in the room.
